Tahkimde geçici hukuki korumalar ve mahkemelerin yardımı ve denetimi

Abstract

Uluslararası ticaretin gelişmesine ve onun ihtiyaçlarına paralel olarak son yüzyılda tahkim kurumu gelişmiş, devlet mahkemelerinin tahkim yargılamasına yardımı ve tahkim yargılamasını denetimi oldukça sınırlandırılmıştır. Böylece, tahkimin bağımsız ve özerk bir yargılama yöntemi olarak kabulüne imkan sağlanmıştır. Türkiye, tahkim konusundaki önemli tüm uluslararası anlaşmalara taraf olmuştur. Tahkim konusunda iki temel kanun olan MTK ve HMK, UNCITRAL Model Kanunu esas alınarak düzenlenmiş ve tahkim konusundaki çağdaş eğilim, pozitif hukukumuzda yerini almıştır. Tahkim yargılamasında devlet mahkemelerinin yardımı ve denetimi konusunda ve özellikle de ihtiyati tedbir ve ihtiyati haciz konusunda HMK ve MTK arasında bazı farklar bulunmakla birlikte, anılan kanunlardaki düzenlemeler uluslararası düzenlemelerle ve tahkim konusundaki çağdaş anlayışıyla uyumludur. TTK'da geminin ihtiyati haczi konusunda, tahkime tabi uyuşmazlıklarla ilgili olarak mahkemeye verilen yetkiler de HMK ve MTK düzenlemeleriyle çelişmemektedir.Arbitration has been developed over the last century following the development of international trade. The role of State courts in the arbitration proceedings has been limited, which allowed arbitration to be conceived as an independent and autonomous dispute resolution method. Turkey has been a party to all major international agreements on arbitration. Turkish International Arbitration Law (TIAL) and Turkish Civil Procedure Law (TCPL), the two key laws on arbitration, are drafted on the basis of the UNCITRAL Model Law. Current trends in international arbitration have therefore been implemented in our positive law. There are some procedural differences between TIAL and TCPL regarding the assistance and supervision of the State courts, especially in precautionary measures and provisional attachment. However, the regulations in the aforementioned laws are in line with the international regulations and current understanding of arbitration. State courts’ jurisdiction under the Turkish Commercial Code (TCC) regarding arrest of ships in the disputes subject to arbitration does not conflict either with the TCPL and TIAL regulations.
