Karşılaştırmalı hukuk bakış açısıyla 1982 anayasasında silahlı kuvvetlerin yürütme ve yargı tarafından denetimi

Abstract

Bu makale, silahlı kuvvetlerin sivil kontrolü sorununu yürütme ve yargı organı çerçevesinde ele almaktadır. Makalede son yıllarda gerçekleştirilen reformlar ışığında sivil-asker ilişkilerinin anayasal sistem içindeki konumu diğer demokratik devlet sistemleri ile karşılaştırmalı bir şekilde ele alınmakta, silahlı kuvvetlerin demokratik kontrolünü güçlendirecek anayasal çerçevenin temel dayanakları tartışılmaktadır. Türkiye ve diğer Avrupa Konseyi üyesi devletlerin anayasal düzenlerinde askerlerin sivil kontrolüyle ilgili temel düzenlemelerden hareketle ordunun sivil denetimine ilişkin anayasal hükümler gözden geçirilmekte, 1982 Anayasasının demokratik kontrol sistemi ele alınmaktadır.This article tackles the issue of civilian control of the armed forces within the framework of the executive and judicial organs. The fundamental principles of the constitutions that will strengthen the democratic control of the armed forces will be discussed and, in the light of reforms undertaken in recent years, provisions of the 1982 Constitution on civil-military relations and democratic control of the military will be handled with a comparative constitutional methodology. Departing from this comparison between constitutional systems of Turkey and other Council of Europe member states, constitutional provisions on democratic control of the military in 1982 Constitution will be reviewed.
