Kefalet türleri

Abstract

Kefalet türleri şunlardır: 1) Âdi kefalet, 2) Müteselsil kefalet, 3) Birlikte kefalet, 4) Kefile kefalet, 5) Rücua kefalet, 6) Açığa kefalet. Bu makalede (tebliğde), söz konusu kefalet türlerinin her birine ilişkin olarak, özellikle 6098 sayılı Türk Borçlar Kanunu'nda, mülga 818 sayılı Borçlar Kanunu'na göre yapılmış olan aynı veya farklı düzenlemeler hakkında açıklamalarda bulunulmuştur. Bu konularda söz konusu olan bazı hukukî problemler ve bunların çözümlerine ilişkin olarak, önce doktrinde ileri sürülen bazı görüşler belirtilmiş ve daha sonra kişisel değerlendirmeler yapılmış ve "Sonuç" bölümünde de, varılan sonuçlar, maddeler hâlinde özetlenmiştir.The types of bailment are: 1) Ordinary Bailment, 2) Joint Bailment, 3) Joint and Several Bailment, 4) Bailment for the benefit of the bailor, 5) Reciprocal bailment 6) Bailment of safe custody. In this article (presentation), all types of Bailment Contracts are examined particularly in the context of Turkish Code of Obligations (no. 6098) and within the regulations contented in the similar or different way in former Code of Obligations (no:818). Some Legal problems in these issues and the solutions to them are studied through mentioning views in Turkish legal doctrine at first and personal views explained and in "the Conclusion" finding of facts are summarized specifically.
