İcra ve İflas Hukukunda tazminatlar

Abstract

Çalışmamızın konusu İcra ve İflas Kanununda düzenlenenler tazminatlardır. Yürürlükte bulunan 2004 Sayılı İcra İflas Kanununun içerisinde "tazminat" kelimesi otuz yedi defa kullanılmıştır. Bu kullanımlardan yirmi altı tanesi dokuz maddeye yayılmış şekilde bir tarafın karşı yana ödemesi gereken bedel anlamındadır. İİK m.67'de düzenlenen icra inkar tazminatı ve kötü niyet tazminatı olarak tanımlanan bu yaptırımlar diğer maddelerde de adı geçen tazminatların özü niteliğindedir. Bu nedenle çalışmamızda öncelikle İİK m. 67'de düzenlenen tazminatlar açıklanmıştır. Çalışmamızın birinci ve ikinci bölümünde İİK m. 67'de yer alan icra inkar tazminatı ile kötü niyet tazminatının kanunumuza girişi ve tarihçesi, tanımı, hukuki niteliği, amacı ve şartları detaylı biçimde ele alınmıştır. Çalışmamızın üçüncü bölümünde İİK m. 67 dışında düzenlenen diğer tazminatlar tek tek ele alınarak şartları ve meydana çıkış unsurları üzerinde durulmuştur. Bu maddelerde yer alan tazminatların icra inkar tazminatı ya da kötü niyet tazminatı olup olmadığı, hangi statüde değerlendirilmesi gerektiği irdelenmiştir.The subject of our study is the compensations regulated in the Code of Enforcement and Bankruptcy. The word "compensation" is used thirty-seven times in the Code of Enforcement and Bankruptcy numbered 2004. Twenty-six of these uses mean the charge one party has to pay to the opposite side, stated within nine articles. These sanctions defined as compensation for denial of execution and compensation for bad faith damages in article 67/2 within Code of Enforcement and Bankruptcy, are in the form of essence regarding the compensations stated in the other articles. Therefore, compensations regulated in Article 67 of the Code of Enforcement and Bankruptcy are explained primarily in our study. In the first and second chapter of our study, introduction to our law, history, definition, legal characteristics, purpose and conditions of compensation for denial of execution and compensation for bad faith damages have been addressed in detail which are covered in Article 67 of the Code of Enforcement and Bankruptcy. In the third chapter of our study, the compensations regulated in nine separate articles are addressed individually, and their conditions and emergence factors are emphasized except for the compensations regulated in Article 67 of the Code of Enforcement and Bankruptcy. Whether the compensation within these articles is the compensation for denial of execution and compensation for bad faith damages, and in which status these compensations have to be assessed have been examined.
