Fikir ve Sanat Eserleri Kanunu kapsamında eser sahipliği kavramı

Abstract

Düşünme yetisine sahip olan insanoğlu kendini tanımlamaya başladığı andan itibaren bir ihtiyaç olan sanat ile sürekli hemhal olmuştur. Mağara duvarlarına çizilen figürlerden itibaren sanatsal üretim süreci içerisinde olmuşlardır. Mağara duvarlarına çizilen ilk eserlerin anonim olması sebebiyle sahipliği sorununun çözülemediğinin farkına varan eser sahipleri eserin kendilerine ait olduğunun ispatı için çeşitli yollara başvurmuşlardır. Bu çözümler eser çeşitlerinden her biri için farklılık arz etmiştir. Düşünsel ve sanatsal yaratma yetisine sahip insanoğlu söz konusu yaratımsal yeteneklerini kullanarak ortaya koyduğu fikir ve sanat eserlerinde eserin sahipliği sorunsalı tüm dünyada gündeme gelmiştir. Bu sorunun varlığını gören ve çözülmesi gereken bir algı olduğu noktasında modern hukukta oluşan fikir birliğine istinaden tüm dünyada eser sahipliği üzerine hukuksal düzenlemeler yapılmıştır. Eser türlerinin çeşitliliği dikkate alındığında bu çeşitlilik kapsamında eser sahipliği kavramının tanımlanması gerektiği açıktır. Söz konusu eser türlerinin sahipliği noktasında oluşacak sorunların çözümü iç hukukumuzda Fikir ve Sanat Eserleri Kanununda detaylı olarak belirtilmiştir. Fikir ve Sanat Eserleri Kanunu'nda eser ve eser sahipliği kavramları üzerinde geniş bir biçimde durulmakta ve eser sahipliğinden kaynaklanan hakların devlet eliyle korunacağı taahhüt edilmektedir. Eser türlerinin çeşitliliği ve bu buna bağlı olarak gelişen eser sahipliğinin çeşitliliği düşünüldüğünde, ortaya çıkacak problemlerin çözümünün gerektiği muhakkaktır. Dava açma hakkı sayesinde eserin sahipliği tespit edilmekte ve bu sahipliğe bağlı haklar korunmaktadır. Çalışmamızın konusu Fikir ve Sanat Eserleri Kanunu'nda yer alan eser kavramının ve eser sahipliği kavramının teorik açıdan incelenmesidir. Eser ve eser sahipliğinin incelenmesinden sonra eser sahipliği noktasında yaşanacak sorunların çözüm yolları da tarafımızca incelenmiştir. Çalışmada literatür geniş bir biçimde taranmış ve konunun teorik içeriği geniş bir biçimde ele alınmıştır. Çalışma içerisinde yer yer örnek yargı kararlarına yer verilmiş ve konunun pekiştirilmesi amaçlanmıştır.The human being, who has the ability to think, has always been in constant distinction with the art, which is a necessity from the moment he begins to define himself. They have been in the artistic production process since the figures drawn on the cave walls. Realizing that the first works drawn on the walls of the cave were anonymous and that the ownership problem could not be solved, the owners applied various ways to prove that the work belonged to them. These solutions differed for each of the work types. The problem of ownership of the work in the ideas and art works that the human being, who has the ability to create with intellectual and artistic creation by using the said creative abilities, has come to the agenda all over the world. In view of the fact that there is a perception that needs to be solved and that this problem exists, legal arrangements have been made on the ownership of the work all over the world based on the consensus formed in modern law. Considering the diversity of the types of works, it is clear that the problem of work ownership is a concept that needs to be solved. The solution of the problems that will occur at the point of ownership of the works in question is explained in detail in the Law on Intellectual and Artistic Works in our domestic law. The Law on Intellectual and Artistic Works extensively focuses on the concepts of work and ownership, and pledges that the rights arising from the ownership of the work will be protected by the state. Considering the diversity of the types of works and the diversity of the ownership of the works developed accordingly, solutions are needed for these problems. The right to file a lawsuit determines the ownership of the work and protects the rights attached to it. The subject of our study is the theoretical examination of the concept of work and the concept of ownership in the Law of Intellectual and Artistic Works. After the examination of the work and the ownership of the work, the solutions of the problems to be experienced at the point of the work ownership were also discussed by us. In the study, the literature has been extensively searched and the theoretical content of the subject has been discussed extensively. Sample judicial decisions were included in the study and it was aimed to reinforce the issue.
