Türk medenî hukukunda aile içi şiddet ve kadının ve çocuğun korunması

Abstract

Türk Medenî Hukukunda Aile İçi Şiddet ve Kadının ve Çocuğun Korunması konulu yüksek lisans tezimizin odak noktasını, özellikle son yıllarda çok sık karşılaştığımız kadına karşı şiddet vakalarının nişanlanma, evlenme ve boşanma süreçlerine yapacağı etkileri ve aile içi şiddete maruz kalan kadın ve çocuğun korunması için devletin sorumlu olduğu yükümlüklerin tespit ve kapsamı oluşturmaktadır. Üç ana bölümden oluşan çalışmamızın ilk bölümünde, şiddet ve aile içi şiddetin mahiyeti, türleri ve olası nedenlerine temas edilmiş, ardından da ulusal ve uluslararası mevzuatta ele alınış biçimi hakkında bilgi verilmiştir. İkinci bölümde nişanlanma, evlenme ve boşanma konuları ana hatlarıyla anlatılarak, şiddetin bu süreçlerdeki tezahürü ile bunun sonucunda oluşabilecek hukuki durumlar üzerinde durulmaya çalışılmıştır. Üçüncü ve son bölümde ise, aile içinde yaşanan şiddet vakalarına karşı devletin, hangi hallerde ve ne şekilde müdahale etmesi gerektiği hususları üzerinde durulmuştur. Bu çerçevede Türk Medeni Kanunu ve 6284 sayılı Aile İçi Şiddet ve Kadına Karşı Şiddetin Önlenmesine Dair Kanun kapsamında, hâkimin ve idarenin kadın ve çocuğun korunması adına alabileceği koruyucu ve önleyici tedbirler ele alınmıştır.Domestic Violence In Turkish Civil Law and Protection of Women and Child The focal point of our master's degree thesis themed ''Domestic Violence In Turkish Civil Law and Protection of Women and Child'' consists of the impacts of violence against women on the process of engagement, marriage and divorce, which are faced with frequently nowadays and the scope of the state's responsibilities for protecting women and children exposed to domestic violence. In the first part of the thesis which is comprised of three basic parts, I have provided information about definition, reasons and types of violence, domestic violence and the coverage of violence in national and international legislations. In the second part, by covering the basics of engagement, marriage and divorce thoroughly, the effects of violence on these topics and legal situations resulting from these effects have been emphasized. In the third and last section, it is examined how the state should interfere the domestic violence incidents when they occur in a family. In this context, I have stated the preventive measures that may be taken by the judges and administrators on behalf of the protection of women and children in the Turkish Civil Code and the Law no: 6284 to Protect Family and Prevent Violence Against Women.
