Markanın kullanılmaması sebebiyle iptali

Abstract

Marka, bir işletmeye ait mal veya hizmetin diğer işletmelerin mal veya hizmetlerinden ayırt edilmesini sağlayan işaretleri ifade etmektedir. SMK tarafından bir markanın korunabilmesi için sicile tescil edilmesi gerekmektedir. Tescil edilen marka, marka sahibinin tekelindedir. Marka sahibinin tescilden kaynaklı haklarının varlığını sürdürebilmesi için markanın kullanım zorunluluğu bulunmaktadır. Marka kullanım zorunluluğu uluslararası sözleşmeler ve SMK'da düzenleme altına alınmıştır. Kanun koyucu tarafından marka kullanım zorunluluğunun getirilmesinde, markanın gerçek kullanımını teşvik etmek ve markaların sicilde boş yere durmasını engellemek amaçlanmaktadır. Bu kapsamda tescilli bir markanın Türkiye'de, işlevine uygun ve ciddi olarak tescil edildiği mal ve hizmetler için marka sahibi tarafından kullanılması aranmaktadır. Markanın kullanılmaması durumunda marka sahibine beş yıllık hoşgörü süresi tanınmaktadır. Bu süre boyunca markanın kesintisiz şekilde kullanılmaması halinde kullanılmama sebebiyle markanın iptali gündeme gelmektedir. Bu durumun istisnası ise kullanılmamaya ilişkin haklı bir sebebin varlığıdır. Günümüzde markanın kullanılmaması sebebiyle iptali konusunda mahkemeler yetkilidir. Ancak 10.01.2024 tarihi itibariyle TPMK'nın idari iptal yetkisi uygulanmaya başlayacaktır. Bu çalışmada, SMK'da tescilli bir markanın kullanılmama sebebiyle iptalinin nasıl gerçekleştiği incelenmiştir. Mülga 556 sayılı KHK'nın aksine SMK'da markanın iptal ve hükümsüzlük halleri ayrı maddelerde düzenleme altına alınmıştır. Çalışmada markanın kullanılmaması sebebiyle iptaline ilişkin uygulamada yaşanan sorunlar ve çelişkiler doktrin ve Yargıtay Kararları ışığında çözüme kavuşturulmaya çalışılmıştır.Trademark refers to the signs that distinguish the goods or services of an enterprise from the goods or services of other enterprises. In order for a trademark to be protected by SMK, it must be registered in the registry. The registered trademark is the monopoly of the trademark owner. In order for the trademark owner to maintain the rights arising from the registration, the use of the trademark is obligatory. The obligation to use the trademark is regulated in international agreements and SMK. In the introduction of the obligation to use the trademark by the legislator, it is aimed to encourage the real use of the trademark and to prevent the trademarks from standing idle in the registry. In this context, a registered trademark is sought to be used by the trademark owner in Turkey for goods and services for which it has been seriously registered in accordance with its function. If the trademark is not used, a five-year tolerance period is granted to the trademark owner. If the trademark is not used uninterruptedly during this period, the cancellation of the trademark arises due to non-use. The exception to this situation is the existence of a justifiable reason for non-use. Today, courts are authorized to cancel the trademark due to non-use. However, as of 10.01.2024, the administrative cancellation authority of TPMK will begin to apply. In this study, it is examined how the cancellation of a registered trademark in SMK due to non-use occurs. Contrary to the repealed Decree No. 556, the cancellation and invalidity of the trademark are regulated in separate articles in the SMK. In the study, the problems and contradictions experienced in practice regarding the cancellation of the trademark due to non-use were tried to be resolved in the light of doctrine and Supreme Court Decisions.
