Türk hukukunda hakaret suçu

Abstract

Günümüzde hakaret suçu sık işlenen suçlar arasında yer almaktadır. Bizim hukuk sistemimizde hakaret suçunun kişilerin onur ve saygınlığı korumak amacıyla suç olarak tanımlandığı görülmektedir. Hakaret suçu, 5237 sayılı TCK'nin ''Kişilere Karşı Suçlar'' adlı 2. kısmının 8. bölümünde ''Şerefe Karşı Suçlar'' bağlamında 125-131. maddeleri arasında düzenlenmiştir. 5237 sayılı TCK'nın getirdiği sistemde genel tahkir suçları ile özel tahkir suçları arasında ayırım yapılmıştır. Bu çalışmada sadece yasal düzenlemenin 125-131 maddeleri arasında düzenlenen genel tahkir suçları ele alınmıştır. 5237 sayılı TCK ile 765 sayılı TCK arasında hakaret suçunun ele alınışı ve hükme bağlanması açısından bazı farklılıkların olduğu söylenebilir. Bunlardan en önemlisi, 5237 sayılı yasada ''hakaret'' ve ''sövme'' arasındaki farklılığın giderilmesidir. Hakaret suçunun düşünce ve ifade özgürlüğü, basın ödevi, eleştiri hakkı gibi temel hak ve özgürlüklerle yakın bir ilişkisi vardır. Bu hakların belirlenen ölçütlerde kullanılması halinde failin eylemi hukuka uygunluk nedeni olarak kabul edilecektir. Ancak bu hakların da sınırsız olmadığı ve sınırlarının aşılması halleri yaptırıma bağlanmıştır.Today,offense of libel is one of the most common crimes. In our judicial system, it is seen that the offense of libel is defined as a crime in order to protect the honor and prestige of individuals. The offense of libel is regulated between articles 125-131 in the context of crimes against honor in the 2nd tranche of the 8th part ın Turkish Punitive Statue,number 5237, titled Offenses against Indıvıduals. In the system of the Turkish Punitive Satue, No 5237, a distinction is made between the crimes of general indignities and special indignities. In this study, only general indignity crimes, which are regulated in sections between 125-131 of the legal regulation, are discussed. It may be said that there are some differences between the Turkish Punitive Statue Number 5237 and the Turkish Punitive Statue Number 756 in terms of handling and adjudicating the crime of libel. One of the most important of these is the elimination of the difference between ''libeling'' and ''cursing'' in law number 5237. The offense of libel has a close relationship with fundamental rights and freedoms such as freedom of thought and expression, duty of the press, and the right to criticize. In case of using these rights according to determinated criteria, the perpetrators' action is accepted as a reason for compliance with law. On the other hand, the cases ,that these rights are not unlimited and exceeding the limits, are sactioned.
