Güvenlik Devleti: Leviathan’dan Hukuk Devletine, Hukuk Devletinden Leviathan’a

Abstract

Güvenlik herhangi bir tehdit veya tehlikeden uzak halde bulunma durumunu ifade etmek için kullanılan bir kavramdır. Güvenlik devletinin ortaya çıkışı ise modern devletin doğuşuna paralel olarak gerçekleşmiştir. Nitekim modern devlet düşüncesinin fikir babası sayılan Hobbes güvenliği devletin varlık sebebi olarak ele almıştır. Fonksiyonu güvenlik ve adaleti sağlamaya indirgenen liberal devlet ise güvenliği hak ve özgürlükleri sınırlandırma aracı olarak hukukileştirmiştir. Bununla birlikte 20.yy. güvenliğin hiç olmadığı kadar öne çıktığı bir çağdır. 9/11 sonrası dönem ise güvenliğin hikmet-i hükümetin yerini aldığı yeni bir dönem olmuştur. Korkunun ayakta tutulmak zorunda olunduğu ve olağanüstü halin olağanlaştığı bu dönem, güvenlik devletinin ortaya çıktığı dönemdir.

Security is a concept used to express the situation of being away from any threat or danger. The emergence of the security state has occurred in parallel with the birth of the modern state. Thus, Hobbes, who is accepted as the founding father of modern state, considered security as the state’s reason for existence. The liberal state, whose function is limited to providing security and justice, legalized security as a tool for limiting fundamental rights and freedoms. However 20th century has been an era in which security has become prominent as never before. And eventually the post-9/11 period became a new era in which security has replaced the state of reason. Besides, the security state has emerged in this period which the fear had to be maintained and the state of emergency became ordinary.
