Eser sözleşmesinde iş sahibinin dönme hakkı (Ayıp ve temerrüt halleri hariç olmak üzere)

Abstract

Eser sözleşmesi, ülkemizde yaygın olan ve sosyo-ekonomik sistemdeki gelişimler ile dinamikleri değişen bir sözleşmedir. Son yıllarda yaşanan hızlı sanayileşme, teknolojik gelişmeler ve kentsel dönüşüm projeleri ile birlikte eser sözleşmeleri çeşitlilik ve önem kazanmıştır. Eser sözleşmesinde, bir yanda yüklenici diğer yanda iş sahibi bulunmaktadır. Pratikteki uyuşmazlıklar büyük oranda eser sözleşmesinin yüklenici tarafından gereği gibi ifa edilmemesi çerçevesinde yoğunlaşmıştır. Bu çalışmada iş sahibinin, işin uzmanı olan yükleniciye göre daha fazla hukuki himayeye ihtiyaç duyması nedeniyle menfaatler dengesini korumaya özen göstererek ve ortaya çıkan uyuşmazlıklarda adil bir denge sağlamaya çalışarak iş sahibinin eser sözleşmesinden dönme hakkı anlatılmaya çalışılmıştır. Çalışmamız ayıp ve temerrüt halleri hariç tutulmak üzere sınırlandırılmıştır. Bu çerçevede çalışmamız, eser sözleşmesine genel hatlarıyla yer verilmesinin ardından iş sahibinin yüklenicinin işe zamanında başlama ve gecikmeksizin yürütme borcuna aykırı davranması nedeniyle dönme hakkı ve eser sözleşmesinin yaklaşık bedelinin aşılması nedeniyle dönme hakkı başlıkları çerçevesinde şekillenmiş, tüm bu durumların hukuk düzleminde yarattığı sonuçlar doktrin ve Yargıtay kararları ışığında irdelenmiştir.Freelance contract is common in our country and its dynamics change with the socio-economic development. The rapid industrialization, technological developments and urban transformation projects that have taken place in recent years have resulted in the diversity and importance of freelance contracts. Parties of a freelance contract are the contractor and the owner of the work. Practical disputes are largely concentrated on the fact that the freelance contract is not fulfilled as required by the contractor. In this study, owner's right to waive a freelance contract is tried to be explained by paying attention to preserving the balance of interests and by trying to establish a fair balance in the emerging conflicts because of the owner's need of protection against the contractor that is already expert on the work. Our work is limited to exclude defect and default circumstances. Within this framework after the freelance contract is included with its general outlines, it is framed with the titles of the owner's right to waive; due to contractor's infraction of his liability of duly commence and execution without delay, due to exceedance of approximate value of freelance contract. The outcomes on legal level of all these cases have been examined in the light of the doctrine and Supreme Court decisions.
