Yasal bir hakkın kullanılması cezai mirasçılıktan çıkarılma sebebi teşkil eder mi?

Abstract

Türk Medeni Kanunu (TMK) m. 510-512 hükümleri arasında kanun koyucu, mirasbırakanın ölüme bağlı tasarrufu ile saklı paylı mirasçıların mirasçılık haklarını kısmen veya tamamen sona erdiren bir imkan olarak mirasçılıktan çıkarma müessesesine yer vermiştir. Bu müessese, saklı paylı mirasçıları cezalandırıcı veya koruyucu bir etkiye sahiptir. Cezaî mirasçılıktan çıkarma sebepleri, TMK m. 510’da iki bent halinde düzenlenmiştir. Buna göre saklı paylı mirasçının mirasbırakana veya mirasbırakanın yakınlarına karşı işlediği ağır bir suç veya aile üyelerine karşı aile hukukundan doğan yükümlülüklerine aykırı davranışı, cezaî mirasçılıktan çıkarma sebebi teşkil eder. Ancak TMK m. 510 hükmünün çizdiği sınırlar, geniş ölçüde yoruma açıktır. Bu kapsamda, saklı paylı mirasçının, mirasbırakana veya mirasbırakanın yakınları ve aile üyelerine karşı yasal bir hakkını ileri sürmesinin cezaî mirasçılıktan çıkarma sebebi teşkil edip etmeyeceği de tartışma konusudur. Bu bağlamda çalışmamızda öncelikle cezaî mirasçılıktan çıkarmanın tanımı, miras hukuku sistemimizdeki yeri ve şartlarına değinilecek, devamında ise çalışmamızın esasını oluşturan tartışma konusu hususa ilişkin açıklamalara yer verilecektir. Ardından sorunun çözümünde göz önüne alınması gereken ilkeler ile yargı kararları ışığında değerlendirmelerimize ve uygulamada karşımıza çıkabilecek birtakım durumlar üzerinden genel kanaatlerimize yer verilecektir.The legislator sets forth the institution of the debarment from inheritance, which enables the inheritance rights of the inheritors having the reserved portion to end partially or completely by virtue of the testamentary disposition of the decedent under the provisions between Article 510 –512 of the Turkish Civil Code. This institution has a retributive or protective effect for the inheritors having the reserved portion. The causes of the retributive debarment from inheritance are set forth as two subparagraphs under Article 510 of the Turkish Civil Code. In accordance with the mentioned provision, if the inheritors having the reserved portion (i) commit a serious offence against the decedent or his/her the relatives or (ii) breach her/his liabilities arising out and of the family law against the family members; these circumstances constitute a justified reason for the retributive debarment from inheritance. However the limitations determined under Article 510 of the Turkish Civil Code are extensively open to interpretation. Within this framework, it is also the matter in question that whether or not any legal allegation of an inheritor having the reserved portion against the decedent or the relatives of the decedent and her/ his family members constitutes a justified reason for the retributive debarment from inheritance. In this regard, we will firstly describe the retributive debarment from inheritance and will explain its importance in our inheritance law system and its conditions in this study. Subsequently we will explain the below mentioned matter constituting the matter in question which is the essential of our study. Following to the mentioned explanations, we will submit the principles, which should be taken into consideration for the resolution of the mentioned legal problem, and our legal evaluations in the light of the precedent judicial decisions and our general opinions over some circumstances, which we may come up during the law practices.
