Sağlık hukukunda diş hekimliği

Abstract

Türkiye'de sağlık hukuku alanında özellikle son dönemde birçok yeni eser çıkmakta ve gündem oluşturan haberler çerçevesinde sağlık çalışanlarının hakları ve yükümlülükleri sıkça tartışılmaktadır. Diş hekimliği alanında da farklı eserler olmakla birlikte bu eserlerin hukuki sorumluluk kapsamında genel olarak tüm sağlık çalışanlarını ilgilendiren genel örnekler ve konular üzerinden hareket ettiği, diş hekimliğine özel birtakım konuları ele almakta yetersiz kalabildiği görülmektedir. Kaldı ki diş hekimlerinin günlük uygulamada yaşadıkları sorunlar üzerinden özel örneklerle hukuki sorumluluk konusunda mesleki farkındalığın arttırılmasına da ihtiyaç vardır. Tıbbi cihaz ve ürünlerde, sağlık turizmi ile sağlıkta reklam, bilgilendirme ve tanıtım faaliyetlerinde yapılan düzenlemelerde sağlık hakkı ve sağlık hizmetlerine erişim hakkı çerçevesinde insan onurunu merkeze alan uygulamalardan giderek uzaklaşıldığı gözlemlenmektedir. Bu durumun, mezuniyet öncesi dönemde, çekilmiş dişlerde yapılan tedaviler ve gereksinimden doğan tedaviler gibi diş hekimi adaylarının karşılaştığı ciddi hukuki sorunları da kapsamaktadır. Yukarıda belirtilen sorunlar kapsamında çalışmada öncelikle sağlık hakkı ve sağlık hizmetlerine erişim hakkı üzerinde insanlık onurunu merkeze almayan anlayış üzerinde durularak bu hakların farklı beklentiler doğrultusunda nasıl suistimal edildiğine değinilmiştir. Daha sonra hukuki sorumluluk kapsamında konunun diş hekimleri açısından daha anlaşılabilir olması için diş hekimliğine özel örnekler verilmiş ve sağlık ve sağlık hizmetlerine erişim hakkı üzerinde yaşanan sorunların hukuki sorumluluk üzerindeki yansımalarına kısaca değinilmiştir. Son bölümde ise mezuniyet öncesi ve sonrası dönemde diş hekimliği uygulamalarında karşılaşılan sorunlar özellikle sağlık hakkı ve sağlık hizmetlerine erişim hakkı kapsamında yaşanan suistimaller üzerinden eleştirilerek işlenmiştir.In the field of health law in Turkey, especially recently, many new works have been published and the rights and obligations of health workers are frequently discussed within the framework of the news that sets the agenda. Although there are different works in the field of dentistry, it is seen that these works generally act on general examples and issues that concern all health workers within the scope of legal responsibility, and they are insufficient to deal with some specific issues for dentistry. Moreover, there is a need to increase professional awareness on legal responsibility with specific examples based on the problems that dentists experience in daily practice. A distancing from practices that center human dignity within the framework of right to health and right to healthcare in the regulations made in medical devices and products, health tourism, and health advertising, information and promotion activities has been observed. This includes serious legal problems faced by prospective dentists, such as the treatments performed on extracted teeth and the treatments arising out of necessity, during the pre-graduation period. Within the scope of the above-mentioned problems, the study primarily focuses on the understanding that does not center human dignity on the right to health and the right to access health services, and how these rights are abused in line with different expectations. Then, specific examples of dentistry were given in order to make the subject more understandable for dentists within the scope of legal liability, and the reflections of the problems experienced on the right to health and healthcare on legal liability were briefly mentioned. In the last part, the problems encountered in dentistry practices before and after graduation are discussed, especially through the abuses experienced within the scope of the right to health and the right to access health services.
