4857 sayılı İş Kanunu'nda müteselsil sorumluluk halleri

Abstract

İş Kanunu'nda düzenlenen asıl işveren alt işveren ilişkisi, geçici iş ilişkisi, işyeri devri ve iş sözleşmesinin devri hukuki nitelikleri itibariyle üçlü iş ilişkileridir. Esneklik temelli tipik istihdam ilişkilerinde, uygulamada işçi aleyhine ortaya çıkabilecek kötüye kullanımların önüne geçilmesi ve işçilerin işçilik hak ve alacaklarının korunması amacıyla işverenlerin müteselsil sorumluluğu öngörülmüştür. Müteselsil borçluluk, borçlulardan her birinin borcun tamamından şahsen sorumlu olduğu ve borcun tamamı ödeninceye kadar bütün borçluların sorumluluğunun devam ettiği borç ilişkisidir. Başka bir deyişle, alacaklı borçlulardan dilediğine alacağının tamamı için başvurabilecektir. Üçlü iş ilişkilerinde, işverenler (örneğin, asıl işveren, geçici işveren ile işçi arasında mevcut bir ilişki bulunmamasına rağmen) işçinin ödenmemiş işçilik alacaklarından her ilişkinin düzenlendiği madde hükmünde öngörüldüğü üzere müteselsilen sorumlu tutulmuşlardır. Müteselsil sorumlulukta borcun tamamının işçiye ödenmesinden sonra müteselsil borçlulardan her birinin borçtan hangi oranda sorumlu olacağı ise iç ilişkiye göre tespit edilecektir. Belirtmek gerekir ki, kanundan doğan müteselsil sorumluluk hükümlerinin emredici niteliği ve kamu düzenine ilişkin olması sebebiyle işçi aleyhine değiştirilmesi mümkün değildir. Çalışmamızın amacı, İş Kanunu'nda müteselsil sorumluluğun öngörüldüğü üçlü iş ilişkilerine dair hükümleri incelemek ve mümkün olduğu kadarıyla uygulamada ortaya çıkan sorunları tespit ederek konuyla ilgili doktrinde tartışılan hususlara yer vermektir.According to the Labor Law, the relation between primary employer and sub-employer, the temporary employment relationship, the transfer of the workplace and the transfer of the employment contract are in tripartite employment relation by legal character. Due to the flexible atypical employment relations, employers' joint responsibility is envisaged to prevent abuse that may arise in practice and to protect employees' rights and receivables. The scope of the joint indebtedness requires each employer to be personally responsible for the full amount of the payment of the employee. In other words, the employee has a right to bring a claim against either employer. In tripartite employment relations, employers (though the nonexistence of an employment contract does not have an existing employment contract between the employer and the temporary employee) are held jointly liability liable for the payments of the employee, as it is provided in the articles related to the payments of the employee. After the payment of the entire debt to the employee in joint liability, proportion of each of the joint promisers will be determined by the internal relationship. It should be noted that, due to the mandatory nature of the joint liability provisions arising from the labour law and the public order, these, imperative rules cannot be modified against the employee. The aim of this thesis is to examine the provisions regarding the tripartite employment relations and the joint responsibility of employers in the Labor Law and to determine the problems that arise in practice by referring to the issues discussed in the doctrine.
