Abstract

İflasın kapanmasından sonra müflise ait olup da masaya dâhil olmayan ve fakat masaya dâhil olması gereken bir mal veya hakkın varlığı her zaman olası bir ihtimaldir. İşte bu ihtimalin geçekleşmesi halinde, iflas tasfiyesi sonucunda alacağını alamamış alacaklılar için yeni bir umut doğmuş olacaktır. İflasın kapanmasından sonra tasfiyeye tabi tutulmamış bir mal veya hak bulunursa, iflas dairesi o mal veya hakkı paraya çevirecek, elde edilen tutarı da alacağını tam olarak tahsil edemeyen alacaklılara sıralarına göre dağıtacaktır.After closing of the bankruptcy, there can be a good or right that belongs bankrupt but is not included in bankrupt’s estate, and should be included in bankrupt’s estate. In this case, there will be a hope for creditors that could not have obtained their credits. If there is a property or right that not subject to liquidation after the closing of the bankruptcy, bankruptcy office will convert that property or right into money and distribute money to creditors that could not collect exactly their credits, according to the order.
