Çevre hukukunda yeni bir yaklaşım: Çevrenin hakkı

Abstract

Çevreyi korumak için onu hak sahibi bir varlık olarak tanımadan evvel de çeşitli koruma mekanizmaları geliştirilmiştir. Ancak çevre hakkı başta olmak üzere bu hukuki düzenlemelerin hiçbiri çevrenin bozulmasını tam olarak engelleyememiştir. Çevre ile ilgili kaygıların doruk noktasına ulaşması ile birlikte ise çevrenin hakkı kavramının hukukileşme süreci başlamıştır. Ancak çevrenin hukukun karşısında hak sahibi bir varlık olarak tanınması birçok tartışmayı da beraberinde getirmiştir. Nitekim çevreyi korumak için onu hak sahibi bir varlık olarak tanımadan evvel hukuk düzenindeki bu önemli değişikliğin tüm boyutlarıyla beraber değerlendirilmesi gerekmektedir. Bu doğrultuda çevre hukukundaki bu yeni yaklaşımı ele alan çalışmamız iki bölümden oluşmaktadır. Birinci bölümde çevre kavramı, çevre ile ilgili sorunlar ve etik yaklaşımlar incelenmiş, müteakiben hâlihazırda çevrenin korunması konusunda en önemli hukuki düzenlemelerden olan çevre hakkı kavramına değinilmiştir. İkinci bölümde ise çevrenin korunması adına yeni bir çözüm arayışını ifade eden ve çevreyi koruma fikrinin hukuk alanına yansıması olan çevrenin hakkının kavramı anlatılmıştır. Son olarak çalışmada mukayeseli hukukta bu kavramın yer alış şekli ve kavrama getirilen eleştiriler hakkında bilgi verilmiştir.Before recognizing environment as a legal person and giving it rights, various protection mechanisms have been developed. However, none of these legal regulations, especially the right to environment, could completely prevent the deterioration of the environment. After the environmental concerns reached their climax, the legalization of the right of the environment has begun. However, the recognition of the environment as a legal person has also brought many discussion. As a matter of fact, before recognizing environment as a legal entity, this unprecedented approach should be evaluated all together with its every point. Accordingly, our study, which explains this new approach in environmental law, is founded upon two parts. In the first part, the concept of environment, environmental problems and ethical approaches are discussed, then the concept of right to environment, which is currently one of the most important legal regulation on environmental protection, is mentioned. In the second part, the concept of the right of environment, which expresses a search for a new solution for the protection of the environment and is the reflection of the idea of protecting the environment in the field of law, is explained. Finally, this concept in comparative law and the criticisms brought to it are detailed.
