Kadının sağlık hakkı perspektifinden Türkiye’de üreme ve cinsel sağlık hakkı

Abstract

Bu çalışmada Türkiye’de kadının üreme ve cinsel sağlığına ilişkin uygulanan politik ve hukuki düzenlemeler ele alınarak cinsiyete ve medeni duruma dayanan ayrımcılık tespit edilmeye çalışılmıştır. Sağlık hakkı hiçbir statü temeline dayanmadan herkesin doğuştan sahip olduğu temel bir insan hakkıdır. Kadınlar gebelik, doğum, lohusalık, menopoz ve adet döngüsü gibi fizyolojik süreçler yaşadıkları için hastalık ve ölüm riskleri daha fazladır. Üremeye yardımcı tedavi yöntemlerinin sadece evli çiftlere uygulanmasının ve bekar kadınların bu haktan faydalanmasının bir Yönetmelik ile yasaklanmasının uluslararası insan hakları sözleşmelerine ve Anayasa’ya aykırılık teşkil ettiği tespit edilmiştir.In this study, it has been tried to determine discrimination based on gender and marital status by considering the political and legal regulations applied regarding the reproductive and sexual health of women in Turkey. The right to health is a basic human right that everyone has from birth, without any status basis. Because women experience physiological processes such as pregnancy, childbirth, puerperium, menopause, and the menstrual cycle, they are at higher risk of illness and death. It has been determined that the application of assisted reproductive treatment methods only to married couples and the prohibition of single women from benefiting from this right by a regulation constitutes a violation of international human rights conventions and the Constitution.
