Dr. Jekyll’dan Mr. Hyde’a Modern Devlet’in iki yüzü: Liberal Hukuk Devleti’nden Anayasal Diktatörlük’e

Abstract

20. yüzyıl büyük savaşların ve bu savaşlar sonrasında ortaya çıkan totaliter-otoriter rejimlerin yüzyılı olmuştu. Bu dönem aynı zamanda demokrasi ve hukukun üstünlüğü gibi liberal hukuk devleti için vazgeçilmez olan prensiplerin erozyona uğradığı bir çağdı. Bu noktada 21. yüzyıl ise terör eylemleri, salgın hastalıklar ve ekonomik krizler gibi büyük çaplı tehditler neticesinde güvenliğin öne çıktığı bir çağ olmuştur. Bu tehditler karşısında liberal hukuk devletinin yönetim paradigması büyük ölçüde güvenlik lehine kaymıştır. Bütün bu gelişmeler liberal demokrasilerin mutlaklaşma eğiliminin göstergesi sayılabilir. Zira bu dönem, olağanüstü halin olağanlaştırıldığı, hukukun hukuku askıya alma aracı olarak kullanıldığı, hatta güçler ayrılığı doktrinin dahi sorgulandığı bir döneme işaret etmektedir. Bu dönemde ortaya çıkan mutlak rejimlerin tamamı için diktatörlük benzetmesi yapılmıştır. Ancak bu benzetme hatalıdır. Nitekim diktatörlük Roma Cumhuriyeti’nde ortaya çıkmış antik ve anayasal kurumudur. Bu bakımdan liberal hukuk devletinin mutlaklaşma gösteren yönünün hukuki çerçevesini çizmek için başka kurumlara müracaat etmek gerekmektedir.The 20th century was of great wars and totalitarian-authoritarian regimes that emerged after. At this point, the 21st century was an era in which security came to the fore as a result of major threats such as terrorist actions, epidemics and economic crises. In the face of these threats, the administrative paradigm of the liberal state of law, to a great extent, has shifted in favor of security. All these developments can be regarded as indicators of the tendency of the liberal democracies to become absolute. Because this period indicates a period in which the state of emergency was normalized, law was used as a means of suspending law, and even the doctrine of separation of powers was questioned. An analogy was drawn between dictatorships and for all the absolute regimes that emerged during this period. However, this analogy is erroneous. Indeed, the dictatorship is the ancient and constitutional institution that emerged in the Roman Republic. In this respect, it is necessary to look for other institutions to draw the legal framework of the liberal state of law, which tends to be absolute.
