İcra ve iflas hukukunda sirküler

Abstract

Sirküler yoluyla ilgililerin görüşlerinin alınması icra ve iflas hukukumuzda sık rastlanılan bir yöntem değildir. Oysa sirküler yoluyla ilgililerin görüşlerinin alınması oldukça pratik ve az maliyetli bir yoldur. Özellikle alacaklı sayısının çok fazla olduğu iflas tasfiyelerinde alacaklılar toplantısının fiziki olarak gerçekleştirilecek olması önemli sorunları beraberinde getirebilir. İflas idaresinin veya dairesinin hızlı bir şekilde alacaklıların görüşüne ihtiyaç duyduğu durumlarda alacaklılar toplantısının hemen gerçekleştirilmeyecek olması tasfiye sürecinin akamete uğramasına sebebiyet verebilir. Yine kitlelerin bir araya gelmesinin toplum sağlığı açısından zararlı olacağı hallerde sirküler yoluyla kararların alınması mümkün olabilecektir. Çalışmada, İcra ve İflas Kanunu çerçevesinde sirküler yoluna başvurma koşulları, sirküler yoluyla alınabilecek kararlar ve bu kararların kanun yolu incelemesi hususları ele alınmıştır.It is not a common method in our enforcement and bankruptcy law to get the opinions of the concerned parties through circulars. However, it is a very practical and cost-effective way to get the opinions of the interested parties through circulars. Especially in bankruptcy liquidation where the number of creditors is too high, the physical meeting of creditors may bring significant problems. In cases where the bankruptcy administration or its office needs the opinion of the creditors quickly, the fact that the creditors’ meeting will not be held immediately may result in the liquidation process being disrupted. Again, in cases where the gathering of the masses will be harmful for public health, it will be possible to make decisions through circular. In this study, the conditions for the application of circular path, decisions that can be taken through circular path and the legal way review of these decisions are discussed within the framework of the Enforcement and Bankruptcy Law.
