Sağlık Hukuku açısından kanserli hastaları bilgilendirme zorunluluğu ve bilgilendirmenin psikolojik sonuçları

Abstract

Kanser hastalarına gerçeği söylemenin hastadaki psikolojik etkilerini araştırmak, gerçeği söyleme konusunda hasta, hasta yakını ve hekimlerin yaklaşımlarını belirlemek amacıyla yapılan bu çalışmaya 72 şer hasta, hasta yakını, hekim alınmış ve kendilerine birer anket formu doldurtulmuştur. Tanısı söylenen ve söylenmeyen hastalara ameliyatı beklerken ve ameliyattan 3 ay sonra depresyon ve anksiyete testleri yapılmıştır. Hekimlerin %100 ü gerçeğin hastaya söylenmesi kanaatinde olup aynı zamanda hasta yakınlarının da gerçeği bilmesini uygun bulmaktadır. Hasta yakınlarının % 75 i gerçeği hastanın kendisine, %25 i hasta yakınına söylenmesini doğru bulmaktadır. Hastaların %97.2 si tanının kendilerine, %2.8 i yakınlarına söylenmesini istemektedir. Çalışmamızda Aydınlatılmış Onam konusunda hekimlerin % 81.9 unun bilgili, %18.1 inin biraz bilgili olduğuna inandığı sonucu elde edilmiştir. Hastalarda ise %19,4 u bilgili, %44,4 ü hiç bilgisiz, %36,1 i biraz bilgili olarak belirlenmiştir. Hasta yakınlarında ise bilgili %19,4, hiç bilgisiz %38,9, biraz bilgili %41,7 olarak tespit edilmiştir. Hastaların testleri kıyaslandığında gerçek tanı söylenen hastalarda önce depresyon ve anksiyetede yüksek skorlar varken, üç ay sonra her iki testte de skorlarda anlamlı düşüşler saptanmıştır. Gerçek tanı kendisine söylenmeyen hastalarda tanıyı bilen hastalara göre önce skorlar düşük çıkarken üç ay sonra depresyon skorları benzer çıkarken anksiyete testlerinde skorların yüksek çıkması anlamlı bulunmuştur. Bu araştırma tanıya ilişkin doğru tanının hastaya bildirilmesinin yarattığı psikolojik sonuçları ortaya koymuştur. Hasta ve hekim gerçeği hastaya söylemenin doğru olduğunu düşünürken hasta yakınlarının bir kısmı hastaya gerçeği söylememenin daha doğru olacağı kanaatindeler. Yine artık hekimlerin hastalara kanser tanısını söylemede titiz davrandıkları, aydınlatılmış onama önem verdikleri anlaşılmaktadır. Ancak hala hasta ve hasta yakınlarının aydınlatılmış onam hakkında tam bilgili olmadıkları gözlenmiştir.The aim of this research is to investigate the psychological effects of telling the truth about the illness of cancer patients and to determine the approach of patients, patient relatives and physicians to tell the truth. 72 patients, 72 relatives, 72 physicians were included in the study and a questionnaire was completed. Depression and anxiety tests were performed before the operation and 3 months after the operation to the Cancer diagnosed patients. 100% of the physicians are convinced that the truth is being told to the patient himself and at the same time they find it convenient for the patients' relatives to know the truth. 75% of the patient's relatives find it true that the truth must be told to the patient, but 25% to the patient's relatives. 97.2% of the patients want the diagnosis to be told to them and 2.8% of them want to be told to their relatives. 81.9% of the doctors believe that they are well informed and 18.1% believe that there is some knowledge about the informed consent. The knowledge of the patients about the informed consent was 19,4%, 44,4% without any knowledge, and 36,1% with some knowledge. Informed patients relatives were found to be 19.4%, not informed 38.9% and a little informed 41.7%, respectively. When we compared the tests of the true said and not said patients, the actual scores were high scores for depression and anxiety, while the scores for both tests were significantly reduced after three months. However, according to whether the truth about the disease has been said or not the scores were lower before the depression scores were similar after 3 months, whereas the scores in the anxiety tests were higher. This research has revealed the psychological consequences of saying the truth. When the patient and the physician think that telling the truth to the patient is right, some of the patient's relatives believe that it is better to tell the truth to the patient. Again, it is understood that physicians are very careful in saying cancer diagnosis, and they give importance to informed consent. However, it is observed that patients and their relatives are not fully informed about the informed consent.
